Terms and Conditions

Welcome to the terms and conditions of use for the mTransport service (“the Service”), intended for authorized parents and guardians (“you”). This Service is operated by mPhase inc. (“mPhase,” “we,” “our”). We are a Canadian company.

By accessing or using the Service, you agree to be bound by these terms (“Terms”). Please read them carefully before using the Service.

1. Purpose and Acceptance

The mTransport Parent Service provides an online platform, accessible via a free mobile application intended for parents (“Application”) and a website (“Website”) at: https://portail.mtransport.ca, allowing authorized users to view, receive, and communicate information related to a student’s school transportation.

The Service is offered to authorized parents and guardians under a contract between mPhase and the School Organization responsible for the student or students concerned. For the purposes of these Terms, School Organization means the entity responsible for managing school transportation, which may be a school board, a school transportation consortium, a private institution, a school, or a school transportation operator. This contract with the School Organization governs, in particular, the transmission, access, and use of the data necessary for the operation of the Service.

Your use of the Service constitutes a legally binding agreement between you and mPhase. If you do not agree to these Terms set out below, you must immediately stop using the Service.

2. License and Access Conditions

mPhase grants you a personal, limited, non-exclusive, non-transferable, and revocable license.

Eligibility requirements:

  • Be a parent or guardian listed in the student’s school record.

  • Use an email address validated by the School Organization.

  • The School Organization must be subscribed to mTransport.

Access may be revoked at any time by the School Organization.

Note for separated or blended families – shared access to a student record
When multiple authorized parents or guardians are listed in the record, each may access all information related to the child, including:

  • The names of stops on their various school transportation routes.

  • Pick-up and drop-off information for the child if such information is shared by the School Organization.

  • Absence notices submitted by either parent.

3. Features

Features depend on the configuration implemented by the School Organization and the transportation providers.

Examples include:

  • Real-time notifications (vehicle progress, delays, absences).

  • Message history related to the student’s transportation.

  • Reporting an absence for a future date.

  • Adding the student’s photo (internal use only by drivers and administrators, for identification purposes).

  • Notification preference management.

  • Useful information (contacts, calendars, other documents provided by the School Organization).

Features may change, be modified, or removed without notice, depending on Service updates or decisions by the School Organization. The mobile application must be kept up to date; an outdated version may cease to function.

4. User Responsibility

You are responsible for:

  • The confidentiality of your credentials and all activity on your account.

  • Immediately reporting any unauthorized use.

  • Ensuring that the student complies with the School Organization’s instructions.

5. Limitation of Liability

mPhase does not guarantee that the information provided will be error-free, without delays, or uninterrupted. This accuracy of this data depends, in particular, on:

  • The quality and accuracy of the information provided by the School Organization.

  • The proper use of the mTransport service by school bus drivers.

  • Internet and cellular connectivity.

  • The availability of third-party services (Apple, Google, etc.).

Exclusions: To the extent permitted by law, mPhase disclaims any liability for:

  • Errors or omissions.

  • Direct or indirect damages arising from the use of the Service.

mPhase shall not be held responsible for any failure or delay due to events reasonably beyond its control, including but not limited to force majeure, interruptions of third-party services, or natural disasters.

Financial limitation: Any liability is limited to the amount paid to mPhase by a parent for access to the Service in the last 12 months (if applicable).

6. Data Protection

We always comply with applicable laws and regulations, including the Canadian Personal Information Protection Act.

A confidentiality agreement is signed with each School Organization, governing the use of transmitted data (transport planning, passengers, authorized parents’ contact details).

By using the Service, you consent to mPhase collecting, using, and sharing your data with School Organizations and the transportation provider operating your child’s route, solely for the purposes described in these Terms.

Data we collect directly from you includes your email address and information you enter into the Application or Website (such as a student photo, an absence notice, or your notification preferences). Other data related to the student (name, transportation routes, stops, schedules, etc.) is provided to us by the School Organization.

You have the right to access, correct, and delete your personal information in accordance with the law. If your request concerns data provided to us by the School Organization, please contact the School Organization directly.

Parents have access to data for the current school year. Data from previous years is deleted in accordance with contractual agreements.

7. Intellectual Property

All content (texts, images, code, mPhase and mTransport trademarks) is protected by applicable laws. Any unauthorized use is prohibited.

8. Use and Security

You agree not to:

  • Modify, copy, distribute, or decompile the Application or the Website.

  • Use robots or automated scripts.

  • Introduce viruses or disrupt the Service.

  • Attempt to compromise the security or integrity of the Service.

Indemnification: You agree to defend, indemnify, and hold harmless mPhase from any claim resulting directly and exclusively from wrongful use on your part or a breach of these Terms.

9. Changes and Termination

mPhase may modify the Terms at any time by posting the updated version on the Website or the Application. Your continued use after modification constitutes acceptance. mPhase will make reasonable efforts to inform users, including by notification or email, before any substantial changes to the Terms.

We may suspend or terminate your access to the Service in the event of non-compliance with the Terms.

10. Governing Law and Dispute Resolution

These Terms are available in French and English and are governed by the laws of the Province of Québec and applicable Canadian laws. Any dispute will be resolved through arbitration in accordance with the rules of the Québec Code of Civil Procedure, unless otherwise provided by law.

11. App Store Terms

Use of the Application is also subject to the terms of the App Store (Apple) or Google Play (Android), which are incorporated by reference, and you must comply with them.
