INTRODUCTION

Your privacy and the protection of your personal information is very important to MPHASE INC. (“We”, “us”). This Privacy policy (“Policy”) explains the type of information that we collect through the mTransport solution, the purpose of such collection, how that information will be used as well as your rights regarding your personal information.

The mTransport solution consists of a mobile application for drivers (mTransport driver), a mobile application for parents (mTransport parent), an administrative Web portal for managers, and supporting cloud services. This privacy policy covers the whole solution.

MPHASE INC. is bound by a formal confidentiality agreement with each school board or institution subscribing to mTransport.

Any personal information gathered for mTransport will only be used for mTransport and will not be disclosed to any unrelated third party.

MPHASE INC. can, at any time and without prior notice, make changes to the current Privacy Policy. Please check this page regularly in case of changes and updates.

By using the mTransport service, through the web portal https://portail.mtransport.ca or the parent or driver mobile apps, you consent to the collection, storage and use of your personal information by MPHASE INC. in accordance with the provisions of this Privacy Policy. If you do not agree with the terms and conditions of this Policy, you can not use the mTransport service. If you have already downloaded the mobile app, you must stop using the app and delete it from your device.

COLLECTION AND USE OF PERSONAL INFORMATION

In order to provide the service, we must collect certain personal information. Some information is provided by the school boards who have contracted MPHASE INC. The information collected includes, but is not limited to : first name, last name, email address, phone number as well as information regarding your children that are registered for school bus transportation (route, trips, pick-up and drop-off stops)

MPHASE INC. collects and uses the required information for the following purposes :

Create the accounts
Provide the service
Send communications
Communicate with the school board
Comply with any legal and statutory obligation
Understand needs related to school transportation
Improve our products and services
Improve mTransport users experience
Answer questions and comments from users.

MPHASE INC. also uses a web and mobile analysis solution, Google Analytics, which automatically collects anonymous data to provide insights regarding the use of the web site and the mobile applications. The information collected using this method can not be used to personally identify you.

Your personal information remains confidential and is only accessible to the school transportation drivers and managers who are also bound by contract to their protection.

Your information will not be disclosed to any other party, except to our service providers (also bound by confidentiality) to operate the service, or in order to comply with legal obligations.

SECURITY

MPHASE INC. uses industry standard safeguards to protect your personal information, like encryption, access control, principle of minimal information, and deletion of data when not required.

However, no security measure is perfect and we can not guarantee the absolute security of your information. In the event of a security breach affecting your personal information, we will quickly inform you in a transparent manner.

RETENTION OF PERSONAL INFORMATION

We will only retain and use the information provided to run mTransport service. All personal information will be deleted in the event of contract termination between MPHASE INC. and the school board. Most data is also proactively deleted at the end of each school year, unless school boards request us not to.

ACCESS TO A DRIVER’S DEVICE LOCATION INFORMATION WHILE THE APP IS IN FOREGROUND AND BACKGROUND

The mTransport Driver application requests access to precise location data in foreground and background. It uses precise location data during the course of a planned bus route, and reports it to transport managers and authorized mTransport users for them to operate school transportation, and for no other purpose. Location information is only gathered while a route is active. It will continue to be gathered if the driver app is put to the background, as managers must still operate the transport when drivers use secondary applications like a map application. Location information stops being gathered shortly after a route is completed.

The mTransport Parent application does not gather or use location data at all.
